What’s Involved in Determining Hazardous Waste

Wastes generated from the production and processing of marijuana must be evaluated to determine whether they qualify as hazardous waste under state and federal regulations. Per 40 CFR 262.11, each licensee is responsible for properly evaluating their waste and documenting those findings. Materials determined to be non-hazardous can be managed according to 19 CSR 100‑1.150.

Common types of hazardous waste produced at manufacturing, testing, and cultivation facilities include:

  • Methanol

Properly Off-Gassing Biomass

Across the cannabis extraction industry, off-gassing is one of the most overlooked issues. Off-gassing is the process of releasing residual gases, such as butane, from cannabis biomass when solvent-based extraction takes place. Facilities may unknowingly dispose of material too soon, risking workplace safety and rejection by disposal facilities.

Obtaining a Generator ID

Manufacturing, testing, and cultivation facilities must obtain an EPA Identification (EPA ID), managed by MO DNR, if a facility is producing more than the maximum monthly threshold for Very Small Quantity Generators (VSQGs). They can do so by filling out EPA Form 8700-12 and submitting it to an authorized state agency or EPA regional office.

If MO DNR inspects a facility and finds no hazardous waste determination has been documented, the facility may be cited for noncompliance.
